Deputies conducted witness interviews and reviewed video surveillance before determining that Jameis Winston had left the store without paying for .72 worth of merchandise. Deputies interviewed Winston at his home and determined him to be eligible for an Adult Civil Citation. Both Publix, the victim in this incident, and Winston agreed to participation in this voluntary pre-arrest diversionary program aimed at diverting first-time non-violent misdemeanor law violations away from criminal prosecution. Winston was assigned to complete 20 hours of community service and must contact the Adult Civil Citation Program Coordinator within 7 days to begin his participation in the program. When confronted at his apartment later, deputies say Winston told them he forgot to pay for the seafood. Wood says it is up to the discretion of deputies to decide whether someone receives a civil citation and both Winston and Publix had to agree to it. It is typically reserved for first time offenders without a record, Wood said. LCSO says Winston must report to the Civil Citation program within 7 days and complete 20 hours of community service. If he does not comply with the terms, the case would be turned over to the state attorney to consider criminal misdemeanor petit theft charges. Wood says there is surveillance video of Winston in the store. He says Winston ordered the seafood at the counter and had it prepared for him. . . --- News Release: Florida State Athletics April 30, 2014 - 1:30pm Statement from Florida State Athletics Regarding Jameis Winston “As a result of his citation last night, we are suspending Jameis Winston from the baseball team,” said FSU Baseball Coach Mike Martin. “I am confident he will complete his community service obligation and the situation will be resolved soon.” FSU’s Athletic Department Code of Conduct/Discipline Policy provides that a student-athlete with a civil citation is eligible to practice and compete. The decision as to whether they are allowed to practice and/or compete rests with the head coach. “I fully support Coach Martin’s decision and will also make sure that Jameis meets all obligations, which I know he will,” said FSU Football Coach Jimbo Fisher. . . . ........................................................................................................................................................... . .....item 1b1).... Florida State's Jameis Winston was cited for allegedly shoplifting crab legs from Publix. orida State quarterback Jameis Winston was issued a citation Tuesday for shoplifting crab legs from Publix, according to multiple sources. Winston, the reigning Heisman Trophy winner, is a red-shirt sophomore for the Seminoles. "He got an adult civil citation," a trusted source inside Tallahassee Police told Tomahawk Nation. "If he completes the sanctions it will never show up on his record. They commonly give them to juveniles on first criminal offenses. They are now doing it for minor misdemeanors for adults to lower crime rate." Winston tossed the winning touchdown in the National Championship game over Auburn in the closing seconds. On the year, he was 257-384 for 4057 yards and 40 touchdowns with 10 interceptions. Winston has had previous run-ins with the law, but no arrests. He was investigated for an alleged rape, but the State Attorney declined to bring charges due to a lack of evidence. In November, the associated press reported that Winston was questioned about his involvement in a long-running BB gun battle, and that a Burger King reported Winston was stealing soda in a ketchup cup. The timing of the citation is interesting given that the NCAA recently approved unlimited meals for student athletes. Winston was recently voted the quarterback on the Florida State All-Jimbo Fisher team. 11:30 Update: A source inside Florida State's program says that Winston will be fined , required to do community service, and will be suspended from the baseball team until his community service is completed. 11:35 Update: The Leon County Sheriff's Office will hold a 2 p.m. press conference concerning Jameis Winston. 1:38 Update: Jimbo Fisher and Mike Martin have issued statements on Winston being suspended from baseball until he finishes his community service. The Leon County Sheriff’s Office said Winston was not arrested and will not face petty theft charges if he completes the terms of a civil pre-trial diversion program. FSU baseball coach Mike Martin announced Winston has been suspended from the team. "This is not a criminal arrest. This is a civil citation program,” said LCSO Maj. Mike Wood during a Tuesday news conference. . ......................... img code photo ... FSU Number 5 - Jameis Winston cmsimg.tallahassee.com/apps/pbcsi.dll/bilde?Site=CD&D... . An investigation determined Winston left the store about 9 p.m. with crab legs and crawfish he picked up from the deli counter. When deputies went to Winston’s apartment, the FSU redshirt sophomore said he forgot to pay. Publix officials and Winston agreed to the civil-citation procedure that will require Winston to complete 20 hours of community service, among other things. Video surveillance shows the Heisman winner order at the seafood then wander the aisles before leaving. An employee witnessed Winston leave, but thought he was going out to grab a shopping cart, so no one, including a sheriff’s deputy on staff, approached him. After employees realized he left for good, deputies were called about 10 p.m. A “very cooperative” Winston told deputies during questioning at his residence late Tuesday that he simply forgot to pay for the items. “He indicated to the deputies he had forgotten and when he got home he realized that he had not paid, but he in fact made no effort to contact Publix or return to pay prior to the deputy’s arrival,” Wood said. The majority of the 19-page LCSO report was redacted Tuesday. The case is still considered pending since Winston has not yet completed the program. Should he not complete the program, the case would be sent to the State Attorney’s Office for prosecution on a charge of petty theft. “I don’t have a crystal ball. I can tell you that he did exit the store, the items were not paid for,” Wood said. “He was issued a civil citation and has indicated that he has every intention of fulfilling his obligation for the community service hours and most likely restitution as well.” . Page 1 of 3 . Pagd 2 of 3 (Page 2 of 3) Tallahassee attorney Tim Jansen, who is representing Winston in this matter, said the quarterback will be enrolling himself in community service today and will pay in restitution to Publix and 4 to DISC Village, the Tallahassee nonprofit administering the program. The program only applies to certain offenses for those with no criminal history and is designed to keep people out of the criminal justice system, Wood said. The program is used at the discretion of the arresting deputy and administered through the counseling non-profit DISC Village. Jansen, who represented Winston in December when there were allegations he sexually assaulted another FSU student, said he simply forgot to pay for the items from the seafood counter and wasn’t treated any different than anyone else. LCSO has issued 32 civil citations for similar crimes since December for offenders of similar crimes, Wood said. “He got the same availability for that program as someone without a criminal history,” Jansen said. “He cooperated and admitted his role to both the sheriff’s office and Publix.” “Its only a big deal because of who he is. He’s a Heisman winner,” he said. “He’s known nationally and all over the world and he’s a role model to a lot of kids. . --- Jameis Winston statement: Jameis Winston has released the following statement through attorney Tim Jansen regarding his recent citation: "As reported in the news, last night I received an adult civil citation for petit theft from a local supermarket. FSU baseball coach Mike Martin announced earlier Winston has been suspended from the team. "This is not a criminal arrest. This is a civil citation program,” said LCSO Maj. Mike Wood. Reports that Florida State’s star quarterback was arrested on Tuesday are sweeping social media, but hard facts are difficult to come by. Here’s what we know: A report by Tomahawknation.com, citing unnamed sources, says Heisman-winning quarterback Jameis Winston was issued a citation Tuesday for shoplifting crab legs from a Publix supermarket. The Tallahassee Democrat has made a public records request regarding the incident to the Leon County Sheriff’s Office. LCSO officials have told the Democrat to be at their offices at 2 p.m. today. Whatever the case may be, Winston was not arrested or cited by Tallahassee Police Department. “In response to recent requests: TPD has NOT had any contact with Jameis Winston regarding an alleged recent citation,” the department said on its Twitter account. EXCLUSIVE TMZ Sports has just obtained the call a Burger King employee made to police in 2013 -- when she accused Jameis Winston of stealing soda from the restaurant ... and it's clear, SHE'S PISSED. The call was made to a non-emergency police hotline by the assistant manager of a BK located right near the Florida State University campus on July 21, 2013. According to cops, Winston allegedly entered the burger joint with 3 other men and began to fill ketchup cups with soda without paying for it. During the call, the employee tells the operator she told Winston what he was doing was a crime -- but "he said he didn't care." The employee noted Winston and his group were "causing a big scene out front" ... and were "fighting with me and refusing to leave." Ultimately, the case was dropped when the manager of BK decided not to prosecute ... and Jameis went on to steal crab legs from a grocery store. The college football offseason is usually filled with horror for fans and coaches, as the ample amount of free time offers plenty of opportunities for athletes to find themselves in trouble. “Distractions,” as they’re so lovingly referred to, can range from simple offenses like barking at dogs like Florida linebacker Antonio Morrison to more serious charges like the four Georgia players who were cashing checks twice to get the money. This time in offseason adventures, it became public by way of Tomahawk Nation that Jameis Winston had been cited for attempting to shoplift crab legs from Publix on Ocala Road. The Leon County Sheriff’s Office held a press conference in which Major Mike Wood stated that there is surveillance video of Winston ordering .72 worth of seafood including crab legs and crawfish at the counter, having it prepared for him and walking out of the store without paying. Winston was confronted at his home later by LCSO deputies and claimed to have forgotten to pay, but had made no attempt to contact Publix to issue payment. Winston was issued an adult civil citation which will be given to the state attorney who may consider criminal misdemeanor petit theft charges if Winston fails to comply with reporting to the Civil Citation program within a week of the offense and doing 20 hours of community service. “This program would have been offered to anyone who met the criteria,” said Wood during the press conference when asked if Winston may have received special treatment because of his celebrity status. The issuance of a civil citation instead of criminal is up to the discretion of deputies and had to be agreed to by both the accused and the accuser. The situation would have had a different outcomes if the Publix had not agreed to a civil citation. According to Wood it is typically reserved for first time offenders without a record. Winston was investigated last year for sexual assault but has no record because an arrest was never made. The Heisman winner was also involved in two minor incidents in his career, shooting a BB through a window and using a ketchup cup to steal soda from Burger King. Florida State Athletics provided statements from both baseball coach Mike Martin and football coach Jimbo Fisher, as well as a reminder about the Athletic Department’s policies following the incident, which clarified that “that a student-athlete with a civil citation is eligible to practice and compete.” “As a result of his citation last night, we are suspending Jameis Winston from the baseball team,” said FSU baseball coach Mike Martin. “I am confident he will complete his community service obligation and the situation will be resolved soon.” “I fully support Coach Martin’s decision and will also make sure that Jameis meets all obligations, which I know he will,” said FSU football coach Jimbo Fisher. Winston himself released a statement through his attorney Tim Jansen. “As reported in the news, last night I received an adult civil citation for petit theft from a local supermarket. I am grateful to be able to participate in the adult citation program where I will complete community service. “I am grateful to be able to participate in the adult citation program where I will complete community service.” According to a source close to the situation, Publix’s policy is to issue civil citations when the correct conditions are met and to ban shoplifters from the Publix affected, however Publix may also choose to extend this ban to any number of additional stores in the chain. . --- Crab Tweets “Winston Steals Crab Legs: Crustacean Cretin Creates Controversy, my column:” @jmnpb996 “Florida CruSTATEcean University” @freakystyley “I’m okay with blaming Winn-Dixie for all of this.” @edsbs “like YOU haven’t shoplifted crablegs from publix” @rembert . . . ........................................................................................................................................................... . . .
